OGHA Directs Lands Bureau To Revoke Title Documents Issued To GPC Properties

Ogun State House of Assembly has passed a resolution directing the State Bureau of Lands and Survey to revoke all land title documents issued to GPC Properties Ltd in respect of a landed property in dispute, and speed-up action on the issuance of land title documents to Prosafe Africa Limited, who has been affirmed to have completed payment.

The passage of the resolution followed the adoption of a report of the Lands and Housing presented by the Chairman, Hon. Damilola Soneye, who equally moved for its adoption, seconded by Hon. Adebisi Oyedele and supported by the Whole House.

The Majority Leader Yusuf Sheriff, thereafter moved for the adoption of the report for passage into House resolution, seconded by the Minority Leader Lukman Adeleye and supported by the Whole House through a unanimous voice vote.

Earlier while presenting the report, Hon. Soneye stated that, “the GPC Properties Ltd does not have the right or legal claim to sub-lease, issue consent or allocate any land within the disputed area, based on the fact that the company cannot give what it does not possess. That Prosafe Africa should take possession of the allocated land as approved by Bureau of Lands and Survey immediately.

Soneye noted that following the receipt of a petition received from Akorede Oduntan & Co. Legal Practitioners, the Committee invited all stakeholders involved in the petition, to a meeting in order to resolve the issue amicably. He noted that after carefully examinatined the documents and viz-a-viz the inspection carried out by the Committee to the Company, the Committee is of the opinion that:

“Since gazette No 8 volume 19 dated 24th February 1994 has been repealed by a law titled “A Bill for a Law to transfer Landed Properties vested in the Ogun State Property and Investment Corporation (OPIC) to the Ogun State Bureau of Lands and Survey”, the land in dispute is under the covers of Bureau of Lands & Survey and not OPIC or GPC Properties Ltd.

The land in dispute falls under 2km corridor acquisition and could only be ratified by Bureau of Lands & Survey and not OPIC.”

The report partly reads that: “Subject to the Survey Plans submitted by the parties (GPC Properties Ltd and Tuns Construction Works Company Ltd), it was discovered that the parcel of Land allocated to GPC Properties Ltd and the parcel of Land claimed by Tuns Construction Works Company Ltd shares a common boundary with each other and does not overlap on each other.

It was confirmed that Prosafe Africa Limited has been allocated a portion of land measuring 8098.530 square meters which falls within the land in dispute and subsequently, outright payments have been made on the allocated land to the State Government through the Bureau of Lands and Survey”.
